SANTA ANA — A former El Modena High School band teacher was convicted Wednesday of having sex with a former teenage student.
Carlie Rose Attebury, 31, broke down in tears when the verdict was read, convicting her of having sex with a band student during his sophomore year at the school in Orange.
A sentencing date was not immediately set.
During the trial, Attebury's attorney, David R. Cohn, conceded that his client would have parties at her home and have sex with former students, but they were all over 18. He denied that Attebury ever had a sexual relationship with underage boys.
The former student, identified in court only as Antone R., testified he met Attebury during his second day at school as a freshman in 2006 when he joined the band program. Now an 18-year-old student at Santa Ana College, he testified that he developed a crush on his teacher in his sophomore year.
"I had ideas, but I didn't do anything about them,'' he testified.
But before the homecoming game during his sophomore year in November 2007, he confessed his feelings for Attebury and kissed her lightly on the lips while the two were in her school office, Antone R. testified.
"I wasn't sure if it would progress forward, then it moved forward to a make-out,'' he said, testifying that the two "French-kissed'' for a minute or so before Attebury pushed him away.
The relationship between the two grew from there, Deputy District Attorney Katherine David said.
"This defendant treated this student as if they were in a boyfriend- girlfriend relationship,'' the prosecutor said, adding they would openly hold hands and kiss at times.
In April 2008, when Attebury moved down the street from Antone R., the two started having sex at her home, David told jurors.
Eventually, some parents involved with the band's booster club started noticing what they thought was a flirtatious relationship between Attebury and her student and confronted her, David said.
Cohn acknowledged Attebury had parties at her house and had sex with some of her former students, as well as other young men, but said all of her lovers were adults.
Rumors "flew around the school and the community about these sexual kick-backs,'' Cohn said.
When confronted first by his principal and later by other school officials, Antone R. denied any illicit relationship with Attebury beyond the homecoming game kiss, David and Cohn said.
